Coach takes a tough stance on counterfeiting

US leathergoods brand Coach has won a lawsuit against a flea market owner who it said knew vendors were selling counterfeit products but failed to stop them.

Coach, which has a reputation for aggressively protecting its intellectual property, sued Frederick Goodfellow of the Southwest Flea Market in Memphis in 2010 after sending him a letter notifying him of counterfeit sales. The police had raided the markets twice to recover counterfeit goods, the ruling said.

Mr Goodfellow argued that he took measures including distributing pamphlets to vendors and posting signs about counterfeit goods. He also called a voluntary meeting with vendors to address the selling of counterfeit goods.

However, a US appeals court upheld the $5 million verdict and ruled in favour of Coach.

Stephen Leffler, who represented Mr Goodfellow, said his client would probably appeal.
