ASICS sues Nine West for trademark infringement
ASICS Tiger Corporation and ASICS Corporation have filed a suit in the Federal District Court in New York against Nine West Group, Inc. for trademark infringement, unfair competition and trademark dilution. ASICS is seeking a preliminary and permanent injunction against any future sales and distribution of the Nine West’s N-Punch shoe, which infringes on its well-known stripe design trademark.
The company is also is seeking damages, costs and legal fees. ASICS is claiming that the Nine West shoe bears a stripe design almost identical to its own stripe design trademark. The company is also claiming that the Nine West shoe is a copy of its Onitsuka Tiger Shoes from the ‘60s, ‘70s and ’80 that ASICS has recently re-introduced to the market place as the Classic Onitsuka Tiger Collection.
ASICS has meanwhile asked the United States Customs Service to detain and seize all infringing Nine West shoes that are being imported into the United States.
