A May 14 trial date in Delaware Chancery Court has been set for IBP's lawsuit against Tyson Foods.

IBP filed the suit in late March to force Tyson to honour its agreement to complete the $4.7 billion merger acquisition of IBP. A Delaware judge last week denied Tyson's motion to dismiss or stay the case, finding that Delaware has "exclusive jurisdiction" in the legal dispute between the two companies. Tyson had sought to have the matter tried in Arkansas, where the company's headquarters is based.
