Appeal court upholds decision against eBay

An appeal court in Paris has upheld a legal judgement against online retailer eBay.

A legal battle between eBay and luxury goods firm LVMH began when the parent company of brands including Fendi, Donna Karan, Givenchy, Kenzo and Louis Vuitton complained that eBay users were using its services to sell counterfeit leathergoods. LVMH won an original court case in June 2008.

The appeal from eBay was based on its claim that it was not responsible for verifying that the goods its users sell are genuine. The appeal court rejected this and said eBay must pay LVMH damages of EUR 5.7 million plus interest, a much lower figure than the original damages award.

LVMH said it was delighted with the result and said the decision opened up the possibility of further action against eBay in other countries.
