Calvin Klein loses CK legal battle

In 2003 Murcia-based Zafra Marroquineros launched a line of luggage, footwear and other leathergoods under the name CK Creaciones Kennya and applied for a European trademark for the name. Calvin Klein raised an objection to the use of the initials CK in the proposed trademarked name.
The EU's Office for Harmonization in the Internal Market, which promotes and manages trade marks and community designs within the European Union, said in a ruling in 2005 that there was no risk of confusion between the two brands. Calvin Klein took its case to court and lost in 2007.
An appeal from the US company has now come before the Court of Justice of the European Union in Luxembourg, resulting in a further ruling in favour of Zafra Marroquineros. The court said the Spanish firm's use of the words Creaciones Kennya with the letters CK meant there was no possibility of confusion.
